Terms of Service
Thank you for using Hibiskurs!
These Terms of Service («Terms») are a binding agreement between you and Hibiskurs covering the use of our website and everything we offer through it (the «Platform»). «Hibiskurs», «we» and «us» refer to the company named in Section 12.
Hibiskurs is a directory. Providers publish listings for courses, seminars, events, excursions, tours, materials, and spaces («Listings»); visitors search them and then register with the provider directly, on the provider's own website or by contacting them. We do not take registrations, we do not process payments between a visitor and a provider, and we are not a party to any contract you conclude with a provider. The one thing you can pay us for is a top listing, described in section 4.
Our Privacy Policy describes what personal data we collect and how we use it. It forms part of these Terms.
1 What Hibiskurs does and does not do
We show you what providers publish. We do not own, run, or check the courses and services behind the Listings, and we are not an education provider, a travel agency, or an insurer.
When you register for something you found here, your contract is with the provider alone. Their prices, dates, conditions, and cancellation rules apply, and you should read them before you register. Questions, changes, complaints, and refunds go to the provider, not to us.
We check neither the accuracy of a Listing nor the identity or qualifications of a provider. Listings can be out of date: a course may be full, moved, or cancelled without our knowing.
2 Your account
You can search Hibiskurs without an account. You need one to publish Listings, to save favourites, to set up search alerts, and to message providers.
Give accurate information when you register, keep your password to yourself, and tell us if someone else gains access to your account. You are responsible for what happens under your account. You must be at least 16 years old, and if you register on behalf of a company you confirm you are authorised to do so.
You can delete your account at any time in your profile settings. Your Listings come down with it.
3 Publishing a Listing
Publishing a Listing is free. You decide what you offer, at what price, and on what terms — we set none of that.
Your Listing must describe a real offering, accurately, and you must keep it current — take it down or update it when something changes. You are responsible for meeting the legal requirements that apply to what you offer, including any permits, insurance, consumer information, and taxes. You must have the rights to every text and image you upload, and you grant us the right to display them on the Platform and to use them to promote your Listing and Hibiskurs, including on search engines and social media, for as long as your Listing is published.
If you link to your own registration page, the traffic we send you is yours to convert. Registration and payment happen entirely on your side, under your terms, and we take no commission on them.
We may decline, edit, or remove a Listing that breaks these Terms, misleads visitors, or does not fit the directory, and we may change how Listings are categorised and displayed.
4 Top listing
A top listing is paid placement. It puts your Listing above the others on the homepage, in search results, and next to similar offers, and it is marked «Top» so visitors can see that the placement was paid for. It does not change anything else about your Listing.
The price is CHF 34.95 including VAT, for three months on one Listing. You buy it yourself in the post editor and pay on the Platform through our payment provider, Stripe. It is a single payment: there is no automatic renewal and nothing to cancel, and the placement ends when the three months run out. Buying again while a placement is still running adds three months to the time left. If we end a placement early, we refund the unused part of the period you paid for.
Paid placement buys position, not results. We do not promise a number of views, clicks, or registrations.
5 Rules of use
When using Hibiskurs, do not:
- publish anything false, misleading, discriminatory, defamatory, or otherwise unlawful;
- publish a Listing for an offering that is not yours, or impersonate anyone;
- use the messaging function or the contact form to send advertising or unsolicited mail;
- scrape, copy, or reuse the content of the Platform beyond normal personal use;
- interfere with the Platform's operation or security, or try to reach data you are not entitled to.
6 Reporting content
If you think something on Hibiskurs is unlawful or breaks these Terms, tell us through the contact form. Describe the content, where you found it, and why. We look at every report, and we remove or block what we find to be unlawful or in breach.
If we remove your content or restrict your account, we tell you and why. You can object through the contact form, and we will review the decision and reply with the outcome.
7 Suspension and termination
We may restrict or close an account and remove its Listings if these Terms are broken, if the law requires it, or if we have good reason to believe the account is causing harm. Where the breach is minor, we give you notice and a chance to fix it first.
If you have paid for a top listing that has not yet run out when we close your account for a reason that is not your fault, we refund the unused part.
8 Availability, warranties and liability
We run the Platform with reasonable care but do not promise it is always available, uninterrupted, or free of errors, and we may change or discontinue features.
We are liable for damage caused intentionally or by gross negligence, and for personal injury, without limitation. Otherwise our liability is limited to the amount you paid us in the twelve months before the event, or CHF 100 if you paid us nothing. We are not liable for what providers do or fail to do, for the courses and services behind the Listings, or for content that others publish. Mandatory provisions of Swiss law remain unaffected.
9 Third-party services
The Platform links to provider websites and uses third-party services, for example sign-in with Google and payment through Stripe. Those providers' own terms apply to them, and we are not responsible for their content or conduct.
10 Personal data
How we handle personal data is set out in our Privacy Policy. Providers who receive enquiries through Hibiskurs are themselves responsible for the personal data in those enquiries and must use it only to answer the enquiry.
11 Changes to these Terms
We may change these Terms. If a change matters to you, we announce it on the Platform or by email at least 30 days before it takes effect. If you keep using Hibiskurs after that, the new version applies; if you do not agree, you can close your account before the date.
12 Applicable law, jurisdiction and contact
Swiss law applies, excluding its conflict-of-law rules and the Vienna Sales Convention. The place of jurisdiction is Zurich, Switzerland. If you are a consumer, you may also sue at your place of residence, and mandatory consumer protection rules there still apply to you.
Should a provision of these Terms be or become invalid, the rest remains in force.
